Assizes taken at Clonmel before Walter Lenfaunt, knight, seneschal of the Liberty of Tipperary, on Thursday next after the feast of All Saints in the 48th year of Edward III.

A fine of 40d. made by Philip Askedell with the Earl, for pardon of all trespasses and felonies made by him in the Liberty up to the present; arson, rape, forstall and treasure trove excepted, by pledge of Thomas Osheth who ought to pay.

A fine of 6s. 8d. which Adam Sweyn made ditto, by pledge of Walter Salle.

A fine of 6s. 8d. which Thomas son of Robert O'Neill made ditto by pledge of . . . De Valle.

A fine of 20s. which which Thomas Brit made ditto, by pledge of William Brit and Walter Salle.

A fine of 6s. 8d. which Philip son of Oliver Ketyng made ditto, by pledge of Walter Lenfaunt.

A fine of 6s. 8d. which which Richard son of Milo Cantewell made ditto, by pledge of . . . and Milo Cantwell.

The reeve and community of the town of Clonmel: fine of 60s. for having the Lord's peace for that they did not deliver a certain Thomas Blak . . . to the Lord's prison whereby he escaped from their custody . . . [?by pledge of] . . . the sovereign, Patrick Hay, Henry Walsh, John Laweles, William Nywebery.

Various fines of different sums made for having peace by Richard and David Stok, Philip O'Dowynyll, William O'Gleesan, etc. . . .

January 1389

Fines taken before William son of Peter le Botiller, seneschal of the Liberty of Tipperary, at Bowlek on Friday next after the feast of St. Hilary in the 12th year of Richard II [January, 1389].

Fines of 6s. 8d. which David Britoun, Nicholas Mor, William O'Laghan and Philip Mouket made with the Earl for having peace for all their trespasses, felonies and outlawries within the Liberty; the four pleas of arson, rape, forstall and treasure-trove excepted.

Fine of 20d. which Roger Fyttheler made with the Earl because he had not the body of William O'Done, chaplain, for whom he was pledge.

Fine of 20d. which John O'Barge made with the Earl, because he had not the body of Richard de le Hagherne, etc.

Fine of 20d. which Richard Spenser made with the Earl because he had not the body of the same Richard, etc.

Fine of 40d. which William Falyagh made with the Earl for having peace for all his trespasses, etc. (as above).

Fine of 40d. which Henry son of Henry de Valle made with the Earl, for having peace, etc. (as above).

February, 5 Henry IV [1404]

Pleas in the Court of the Liberty of Tipperary held at Clonmel before William son of Peter le Botiller, Seneschal [in the 5th year of King Henry IV]. There are 11 small skins, all dirty and much frayed. Amongst the pleas the following may serve as examples:

Inquisition held before William Lewys, Escheator, at Clonmel, on Thursday next after the Feast of Ashes in the 5th year of King Henry [February 1404], by Thomas White, Muriertagh O'Neill, Shane O'Shethe, Shane McCranny, Walter Brown, Henry Bretnagh, Matthew Smythe, Shane O'McKyne, John Ocle, Thomas Ocle, Meiler Bremengham [Bermingham], Philip Walshe. Who say on oath that Thomas O'McKyne on Tuesday next before the feast of the purification of the BVM in the 5th year of King Henry feloniously and by their own authority took Theobald Poer, and English leige, and imprisoned him and held him in iron chains, and do so detain him still at Davymiliston.

April 7, 1429

Letters patent of John, son of William Butler, seneschal of the Liberty of Tipperary.

"Know that James, Earl of Ormonde, for our good service done and to be done granted to us the forfeitures of all lands and tenants, goods and chattels of William O'Shethe, Nicholas son of Richard Kanalyn O'Shethe and Katherine, wife of said Nicholas, outlawed and forfeited for felony within said liberty, which William, Nicholas, and Katherine were indicted before the justices of the said liberty concerning divers transgressions and felonies, and on account of a contention and claim which said William, Nicholas and Katherine made to all the lands and tenements of Crompestown and Elyotesheys which a certain Adam, father of John Birton, formerly let for a term of years to a certain Thomas O'Shethe, ancestor of said Katherine, which term has not yet expired as they say. And we, by reason of said contention and claim, took those lands into the hands of the Earl and occupied them in virtue of his grant as above. And because it appears to the Earl and his council that said Adam had not in those lands and tenements anything but a fee-tail - in which case the death of the father does not prejudice the son in the fief - and similarly because the said John Birton, as son and heir male of Adam, in the assizes held at Clonmel before Theobald le Botiller, seneschal of the Liberty, on Thursday next after the Epiphany in the 8th year of Henry V by a certain writ of the form of donation (per quondam breve forme donacionis in discendere) recovered said lands against William, Nicholas, Katherine, and a certain Anastasia, daughter of John Everard, therefore the Earl by advice of his council has ordered us by writh of Chancery of his Liberty that we immediately remove our hand from the same lands and restore them to the said John Birton. We therefore in virtue of this order, and for 3 marks of silver which said John Birton has paid to us to the use of our castle of Grelaghesford, have restored them to him before God and all the people. So that we the said John Butler and our heirs will never make claim in future upon the same or any parcel thereof.

Given at Clonmel on Thursday next after the Feast of the Close of Easter in the 7th year of Henry VI, April 7, 1429."

1531 - A slip of parchment sewn into a deed of 1545:

It appears by these presents that I, Thomas Tobyne, have received the whole sum in pledge of the town of Bryanyre* from Edmund Tobyne, which was the sum of 22 marks and have received the total sum according to my satisfaction on the 18th day of April in the year 1531, and for a certification of the payment being made I have set my seal on these presents. Witnesses present: Sir David Carran, Henry Finn O'She, Adam O'She, Robert Sawsse, and Thomas McKlanygi.

[*Appears to be a townland or estate in the Compsey ('Comsenach'), in East Tipperary (Barony of Slieveardagh).]



Clonmel, Thursday before the Annunciation of the BVM, 2 Edward VI [March 22, 1548]

Theobald Hackett of Moeldrom, horesman, Thomas fitz Edward Butler of Garane, Walter O'Shee, Philip Duf O'Shee of Grallagh, Philip mac Henry and William fitz Robert fitz William [O'Shee?] late of Kilahee, footmen, stole 15 cows of Richard O'Howne of Butlerswood, at Knockanstalem.


5th Edward VI [1551]
Inquisition at Clonmel

William Fannyng fitz Oliver of Garynegrye and James Fannyng of Garansillaghe, kerns, at Lisnalyn killed one Donald O'Shee late of Modesshell, footman

Richard Toben fitz Walter Duf of Kilfolleghen and Shane mac Teige O'Shee of Ballylomegan, kerns, at Modessell stole 2 sheep of Thomas O'Neill; and Teige mac Robert O'Shee received the felons.



Thursday next after the Annunciation of the BVM 5th Edward VI [March 26, 1551]

Inquisition held at Monnehowne, Tipperary. Thomas McWalter O'Shee, juror.


Monday after Trinity, 7th Edward VI [May 29, 1553]

James O'She, Philip McRichard O'She, John O'She and Mary ne Gillan, wife of William fitz James [O'She?] late of Kilneganaghe, stole a rosary of coral (oraculum de corall) worth 8 l., a shirt, a 'faling,' a woman's tunic (tonica muliebris), an linen cloth called 'a kerche of holand,' two silver crosses worth 3 s., and a gold cross worth 20 s. of John Toben; and Ellicia Nihurrelly, single woman, received the stolen crosses.

Pardon of Nicholas, son of Robert O'Shee of Glaneskeagh, horseman.


January 1, 1593

William Woodlocke of Wodinstown, mortgaged to Edward Hacket of Fethard, merchant, for the sum of 10l. 8s. the town and lands of Rathmackarty and said Edward then gave seisin of the premises to John Everard of Fethard, who in his turn gave seisin to Robert Rothe and Henry Shee of Kilkenny to the use of the Earl of Ormond / now therefore said Piers pays to said Robert and Henry the sum of 10l. 8s. according to the condition of said mortgage deed.


February 5, 1593

Peter Hacket of Rathmackarty, County Tipperary, William Woodlocke of Wodinstowne in the same, and Thomas Stackbolde alias Stapleton of Knockanneviegh in the same, gentlemen, grant to Thomas, Earl of Ormond, all the manors, lordships, messuages, lands, etc., in Rathmackarty, Ballydowlbeg, Kilmeclowre and Gortcrosse in county Tipperary, with the reversions and rents of the same. To hold to the Earl, his heirs and assigns, for ever, and the chief lord of the fees, etc. Patrick Bussher of Kilkenny to deliver seisin.
